TERMS OF SALE
These terms form the basis of the contract between you as my customer & Indulgence by Joséphine. These Terms &your Order are considered by me to set out the whole agreement between you & I for the sale of cakes, bakes & sweet treats, also known as the Product(s). It is your responsibility to check all details before paying for and placing your order, as amendments cannot be made once payment has been received.
DELIVERY/COLLECTION
DELIVERY OF POSTAL ITEMS:
Once the treats have left my premises and are in the hands of a delivery company the delivery is out of my control. I am not liable for any mistreatment of items or any damage of goods due to handling or weather conditions.
COLLECTION:
Once you a collection date and time have been agreed, it cannot be altered. A LATE FEE will be charged to you if you are 15mins late which will need to be paid before your order is handed over.
CANCELLATIONS, RETURNS & REFUNDS
Once an order has been placed, no refunds, cancellations or credits are allowed. As these are food products made to order, there are no returns, refunds or exchanges for hygiene and health and safety reasons.
ALLERGENS & DIETARY REQUIREMENTS
All products are made in a kitchen that handles nuts, gluten & milk, plus all other major allergens. Some products in my Made Without Range may not include certain ingredients, however I cannot guarantee they are “free from” & therefore are not suitable for allergy sufferers.
COMPLAINTS
Complaints are very rare & due to the amount of work put into each individual order, I take them very seriously. Any issues must be brought to my attention within 24 hours of collection or delivery to give a fair opportunity to assess the nature of the complaint.
Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof & providing the other party with a prior opportunity to resolve any issues amicably.
Where the complaint is in regard to the quality of the product(s) then the product(s), or remainder of the product(s), must be returned to me as soon as possible & within 24 hours of collection/delivery to ensure that I am able to fairly assess the nature of the complaint. Please note, I can only deal with the client who placed the original order.
GENERAL TERMS
All designs & intellectual property rights remain the property of Indulgence by Joséphine’. I reserve the right to use images of your order for any form of advertising including web-based promotions, brochures, galleries, & competitions. If you post and tag me in any content online, I will retain the right to share this content by crediting you as the photo owner. Your order constitutes your purchase agreement constitutes the entire agreement & understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes & cancels all prior agreements, statements, representations, understandings, negotiations, & discussions, whether oral or written, between the parties.
Each of the parties acknowledges & agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty, or understanding made prior to this Agreement. Nothing in this paragraph excludes any liability for fraudulent misrepresentation.
In the event that anyone or more such provisions of this Agreement should be deemed to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity & enforceability of the remaining valid & enforceable provisions thereof which shall be construed as if such invalid or unenforceable provisions had not been inserted.
The parties agree to submit to the non-exclusive jurisdiction of the English courts. By making payment, you confirm that you have read & agree to be bound by these Terms & Conditions.
Discount Codes & Promotional Offers Terms & Conditions
1 From time to time, Indulgence by Josephine ("we", "us", "our") may issue discount codes, promotional codes or vouchers ("Codes") that entitle you to a reduction in the price of eligible products purchased through our website or for direct orders for bespoke products.
2 Each Code is subject to these terms and to any additional conditions stated when the Code is issued or advertised, such as a minimum spend, eligible products, a validity period or a limit on the number of uses. We will make any such conditions clear to you before you place your order.
3 Unless stated otherwise, a Code:

(a) may be used only once per customer and per order;
-
(b) cannot be combined with any other Code or offer;

(c) cannot be exchanged for cash or credit, and cannot be used to purchase gift vouchers;

(d) is valid only for the period stated below and expires automatically at the end of that period; and
-
(e) is non-transferable and may not be sold or shared publicly, or used for resale purposes, unless we have expressly issued it for that purpose.
4 A Code must be entered at checkout or you must quote the code in your communication for any bespoke order before your order is confirmed. We are unable to apply a Code retrospectively to an order that has already been placed.
5 If you return or cancel an order in accordance with your legal rights or our Returns and Cancellations policy, you will be refunded the amount you actually paid, after the value of any Code has been deducted. The value of a Code will not be refunded separately or carried over.
6 We may withdraw or amend a Code or promotion at any time, but this will not affect any order you have already placed and we have confirmed. We will not withdraw a Code that has been validly applied to a confirmed order.
7 If we reasonably believe a Code has been misused, obtained or applied in error, or used fraudulently or in breach of these terms, we may cancel the order or refuse to apply the Code. If we do so after you have placed an order, we will tell you promptly and give you the option to pay the full price or cancel the order for a full refund.
8 If a Code is issued or displayed in error, for example a pricing or system fault, we will not be obliged to honour it. This does not affect your statutory rights.
9 Discount codes for bespoke orders are applied on the base price of the order. Discount does not apply to decor and delivery charges. Cake base prices are available on request.
10 Discount codes for website orders are applied to products only and do not apply to postal charges.
11 Any codes distributed via the Palmers Green & Southgate LIFE magazine or leaflets received via Anthony Webb are valid once per customer and expire as follows:

11 Nothing in the Terms for Discount Codes & Promotional Offers affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK consumer law.
